Ms Barnes has admitted the charge and it is found proved.

Penalty:

Ms Barnes is suspended from the end of racing on 4 January 2021 up to and including 14 January 2021. This is 4 days, and she is fined the sum of $250.

Facts:

Following the running of Race 9 the Stewards charged Ms Barnes with a breach of r 638(1)(d) in that she permitted her mount AVINO to shift inwards when not sufficiently clear of ROC MUSIC which was checked near the 900 metres.

Mr Oatham demonstrated on the videos that Mr Johnson was racing outside the Respondent and he improved to her inside. Ms Barnes can be seen to look inwards twice before shifting ground. The first time was when Mr Johnson was to her outside but the second time he was on her inside and she should have seen him. The result was that Mr Johnson had to take hold of his mount in order to avoid Ms Barnes. The side-on video evidenced Ms Barnes was only a length ahead of Mr Johnson when she shifted.

Ms Barnes reiterated that she had looked and said she had not seen that Mr Johnson was to her inside. She emphasised the first time she looked inside he was still racing to her outside. She accepted Mr Johnson had had to check his mount due to her actions.

Submissions for Penalty:

Mr Davidson said Ms Barnes had an exceptional record. She had had only one warning under the careless riding Rule. He described the breach as mid to low range.

Ms Barnes did not disagree with the Stewards’ assessment of the breach and stated she wanted to ride at Greymouth.

Reasons for Penalty:

The breach is mid to low range. The Committee takes a starting point of 5 days’ suspension and a fine of $250 to reflect this. A credit of one day is given for the Respondent’s excellent record and her admission of the breach.
