Decision:

The protest was upheld and ONLY ONE WAY was disqualified from the race.

Consequent upon the disqualification, the amended result promoted (4) BAXTER from 6th placing to 5th.

It was ordered that the dividends and stakes be paid in accordance with the amended result.

Facts:

Following the running of race 4 an Information instigating a protest was filed by Chief Stipendiary Steward, Mr N Ydgren, against ONLY ONE WAY (M Williamson), placed 5th by the judge, on the grounds that it “galloped in excess of 50 metres over the concluding stages”.

Mr Williamson had endorsed on the Information form and signed “I do not contest the protest”.

Rule 870(3) provides: that any horse which breaks from its gait during a race must promptly return to its correct gait.

Section B of the Breaking Horses Regulations provides: that any horse which breaks in the last 200 metres of a race and continues in a break for a distance of 50 metres or greater shall be in breach of Rule 870(3).

Mr Ydgren showed the race video replay of the final 200 metres of the race.

Mr Ydgren identified ONLY ONE WAY (3) in 4th place passing the 100-metre mark. He pointed to the horse shortly after gallop, free of interference, and continue on in a gallop for approximately 70 metres to the winning post, finishing in fifth place. Mr Ydgren sought disqualification of ONLY ONE WAY.

Reasons for Decision:

The Committee was satisfied that ONLY ONE WAY had broken from its gait, free of interference, for approximately 70 metres within the last 200 metres, placed 5th by the Judge, and therefore in breach of Rule 870 (3) and the Breaking Horse Regulation.
