Facts:
Following race 5 an information was filed pursuant to rule 638 (30(b). The informant Mr Coles alleged that Miss Northcott used the whip in an excessive manner on her mount RED HOT.
The committee was shown video footage by Mr C George. Mr Coles told the committee that Miss Northcott struck her mount 18 – 20 times prior to the 200 metres without giving the required respite of 6 strides.
Miss Northcott while admitting the breach, sought clarification from the stewards on the interpretation of the rule.
Submissions for Penalty:
Mr Coles submitted that a breach of this rule generally attracted a fine of $200. However he pointed out that amateur riders as is Miss Northcott do not get paid but nevertheless submitted a fine was necessary as a deterrent.
Miss Northcott made no submissions as to penalty.
Reasons for Penalty:
The committee considered that this was Miss Northcott’s first charge under this rule and her admission of the breach. However in our assessment her actions of striking her mount 18 – 20 times without any respite were excessive and unnecessary.
