Facts:
Prior to the enquiry Mr J Oatham (Stipendiary Steward) registered his conflict with the 2nd horse and took no part in the hearing.

The official margin between 1st and 2nd was a nose.
The informant Mr V Colgan, rider of the second horse, ST MORTIZ filed a protest pursuant to Rule 642(1). He alleged that FRENCH CONNECTION, who was placed 1st, interfered with the chances of ST MORITZ, placed 2nd, inside the final 100 metres.
Submissions for Decision:
Mr Colgan demonstrated the video films and pointed out to the hearing that the winner FRENCH CONNECTION moved out into the tile of the third horse GOLD ROCK in the final 80 metres. Mr Colgan said this movement forced GOLD ROCK onto his mount’s hind quarters 3-4 strides off the post, causing him to take hold of his mount.
Mr Sargent submitted it was clear on the films that Mr Colgan had to stop riding with the whip 10-20 metres off the line. He said that with the nose margin at the finish it was enough to cost ST MORITZ the winning of the race.
Mr O Bosson admitted his mount had run out but did not make contact with ST MORITZ. He said that interference was right on the post.
Miss O’Hearn admitted FRENCH CONNECTION had taken the line of GOLD ROCK but did not think that ST MORITZ was affected.
Mr Williamson, Stipendiary Steward, when asked for his submissions on the incident, said it was clear that FRENCH CONNECTION had moved out into the line of GOLD ROCK, who in turn was forced out onto ST MORITZ in the final stages of the race. He said that Mr Colgan’s riding style changed in the last 3 strides. Mr Williamson said that prior to the incident Mr Colgan was riding forward with the whip and in those final strides was unable to use it at all.
Mr Colgan, when asked, had nothing further to add.
Reasons for Decision:
The committee carefully considered all the evidence and submissions as presented. It was clearly evident on the video films that FRENCH CONNECTION did move out into the line of GOLD ROCK in the final 80 metres. This outward movement resulted in GOLD ROCK hampering ST MORTIZ in the last 20 metres of the race. It was also clear that Mr Colgan was unable to ride his mount out properly in the final 3-4 strides off the post. Because of these reasons and in particular the nose margin between the 2 horses at the post, the committee is satisfied that ST MORTIZ would have beaten FRENCH CONNECTION if interference had not occurred.
