As Mr Bradley admitted the breach, it was deemed to be proved.

Accordingly, Mr Bradley’s riding license is suspended from the close of racing on Friday, 11 September up to and including racing on Thursday, 17  September 2020.

Facts:

Following the running of Race 6 (LISTED HS Dyke Wanganui Guineas 1200m), an Information was lodged by Mr Goodwin alleging a breach of Rule 638(1)(d) in that D Bradley ATISHU permitted his mount to shift out near the 200 metres when not sufficiently clear of FLASH WARRIOR which was checked continuing to shift out and hampering ALICE TINKER.

Mr Goodwin used the videos to highlight the incident that culminated in Mr Bradley’s careless riding charge. It began with Mr Dell moving outwards and contacting Ms Taiaroa’s mount. Mr Bradley was racing in behind Mr Dell, and the outward movement of Mr Dell’s mount allowed a gap to open for Mr Bradley. However, he was soon denied that run due to Mr Dell being dictated back inwards and GENTLEMAN JACK moving slightly in front of him. Mr Bradley then forced his way out when not clear of FLASH WARRIOR (C Dell) which in turn caused interference to ALICE TINKER.

Mr Bradley said the Stewards summed up the incident very well. He explained that he was the victim of interference, and when he went to make his run the horse in front ridden by Ryan Bishop (GENTLEMAN JACK) moved outwards. This caused him to come out further than he intended. Mr Bradley believed that the whole incident cost his filly the race.

Submissions for Penalty:

Mr Goodwin produced Mr Bradley’s riding record which showed his last careless riding charge was in November 2019. Mr Goodwin described today’s breach as low range and submitted that a term of suspension be imposed.

Mr Bradley advised of riding commitments through until Friday 11 September.

Reasons for Penalty:

The Committee considered all submissions.

Mr Bradley was a victim of circumstances when initially a gap opened for him, but then closed due to movement of horses in front of him. It was a listed race and his filly was full of running. Mr Bradley elected to force his way out of a bad position, and in doing so rode carelessly.

The Committee had regard to the events prior to Mr Bradley moving out when not clear of FLASH WARRIOR and understand the reasons why he did so. A rider however has a duty to ensure they are always 2 lengths (their own and 1 other) clear of other runners before changing ground regardless of the circumstances.

Mitigating factors were Mr Bradley’s very good record and his admission of the breach. An aggravating factor was the Listed Status of the race. Under normal circumstances the Committee would have imposed a suspension of 6-7 days, however the impact of Covid 19 on racing, and the restrictions this has brought has been taken into account. Balancing up all factors, it was the Committee’s opinion that a suspension of 3 days was appropriate.
