An Information was presented alleging a breach of Rule 534(1) by Ms Latta in that she failed to scratch her runner JENEVER which had been entered in Race 1, the Jock Harris Memorial 2100, before the requested time.
Ms Latta admitted the charge.
She explained to Mr Goodwin that the horse had earlier been injured and was unable to start but that she had overlooked the requirment, of which she knew, to notify the scratching within the required time.

Mr Goodwin advised that the only aggravating factor was that a horse on the ballot was prevented from starting.

Reasons for Penalty:
In fixing the penalty the Committee accepts that the breach was an unintended oversight. However, a horse on the ballot had been denied the opportunity of a start by the oversight. A starting point guide of a $350 fine is provided if another horse is denied a start by a late scratching of a horse. However, given the financial impact of Covid 19 on trainers, the starting point for a breach is reduced to $200 with an uplift of $50 for the aggravating factor of the impact on another horse.
