Facts:
Following Race 5, Stipendiary Steward Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (b) (ii) in that J Baillee (SMOKEY AFFAIR) used his whip excessively prior to the 100m.
At the outset of the hearing, Mr Baillie confirmed he understood the Rule and that he admitted the breach.
Mr Goodwin played the videos from before the home bend. Mr Bailee used his whip 3 times at the 600m and a total of approximately 12 times prior to the 100m mark. Interspersed with this were occasions where Mr Baillie waved his whip but did not make contact with his mount.
Mr Baillie was satisfied with the number of strikes as counted by the Stewards.

Mr Goodwin said this was Mr Baillie’s first breach of the whip rule since all riders’ records were reset with the implementation of the new guidelines on October 7th 2019. He said the Stewards were seeking a fine for today’s breach.
Mr Baillie said that he was trying to reestablish himself as a rider and was perhaps trying a little too hard. He was keen to give his mount every opportunity to win, and neglected to pay attention to the number of times he used the whip. In response to a question from the Chair, Mr Baillie said that he was in a position to pay off a fine.

2nd breach---$500
3rd breach- suspension
The Committee considered all submissions. Mr Baillie has had only 8 rides in the last 12 months due to breaking a leg. Today’s breach was above midrange at a conservative 12 strikes. For this reason the Committee believed it appropriate to apply an uplift from the starting point. Mr Baillie’s sole income is from riding, and at the present time his opportunities are limited as he attempts to make a comeback following injury and Covid 19. This has been taken into account.
