As Mr Johnson admitted that breach the charge is proved.

Penalty:

We impose a fine of $225.

Facts:

This charge relates to race number 7, the Rich Hill Mile (Group 2). The Information alleged that senior rider Mr C Johnson was unable to make the required weight for ZAH GIRL.

This is in breach of rule 330(3)(c) which provides that:
“A rider shall not fail to ride a horse at the weight at which it is handicapped to race”.

Co-Chief Stipendiary Steward, Mr R Neal advised the Judicial Committee (the “Committee”) that Mr Johnson was unable to make the weight for ZAH GIRL in race number 7. He said that he was advised of this fact via Mr Johnson’s agent that he would struggle to make ZAH GIRLS carded weight of 52kg.

Mr Neal said that a charge of this nature would normally be dealt with by way of a $100 fine (Minor Infringement Notice), but due to the race being a Group 2, Stewards elected to file an Information. The Committee was advised that Mr Johnson presented 1.25kg over ZAH GIRLS carded weight.

Mr Johnson told the Committee that he only found out he had been booked for the ride on ZAH GIRL the previous day, and the engagement was made through his agent. Mr Johnson said that his lowest riding weight is currently 53kg and only if he is given advance warning could he could make 52kg. He said that in this case the one days notice was simply insufficient for him to make the weight. 

Submissions for Penalty:

Mr Neal submitted Mr Johnson has a clear record in relation to this rule, but noted that due to the Group 2 status of the race the Stewards were seeking uplift from the usual $100 fine to one of $200.

Mr Johnson submitted he agreed with the Stewards submissions, but asked the Committee to take into account his good record.

Reasons for Penalty:

In consideration of penalty the Committee has taken into account submissions of all parties and noted that similar breaches in recent Group and Listed races have attracted penalties ranging from $250 - $500. This particular race is Group 2 and this is  factored into our decision making.

The Committee has given Mr Johnson credit for his clear riding record under this rule and also his admission of the breach. The Committee notes the impact of the breach is that connections have been required to engage a replacement rider at short notice. In addition the betting public may have wagered bets on ZAH GIRL with the expectation that Mr Johnson was its declared rider.

Having taken all the circumstances into account the Committee is of the view this matter can be dealt with by way of fine.
