We ruled that "Cam Before The Storm" had been denied a fair start and should be declared a Late Scratching.
Facts:
Following the running of Race 11, The Village Inn TAB & Sports Bar Special HCP Pace, an information requesting a ruling was filed by Stipendiary Steward Wallis. The request for a Ruling was made pursuant to Rule 213(1)(j) as to whether "Cam Before The Storm" had been denied a fair start.
The Information reads as follows:
"I the above named informant seek a ruling in relation to Rule 213(1)(j) from the Judicial Committee - to determine whether Cam Before The Storm was denied a fair start."
Rule 213(1)(j) reads as follows:
"(1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:-
(j) if a horse is denied a fair start and such occurrence materially prejudiced the chances of that horse."
Submissions for Decision:
Mr Wallis with the assistance of the race video described the start of race 11 which was a "standing start" 2500 metre race. "Cam Before The Storm" was drawn 1 and "Alta Capone" was drawn 2. Mr Wallis explained how "Alta Capone" was fractious immediately before the start and as the starting tape was released moved down onto "Cam Before The Storm". As a consequence "Cam Before The Storm" received a significant check and the horse's chances in the race were materially prejudiced.
Stipendiary Steward Mr Quirk identified the exact point at which the starting tape was released and this was compared with another camera angle to identify the downward movement of "Alta Capone" onto "Cam Before The Storm".
Mr Butt gave evidence stating his chances of getting a fair start had been adversely affected by the contact on his horse by "Alta Capone". He described how "Alta Capone" had stepped across in front of his horse just prior to the starting tape being released and continued across at about the time the tape was released. He acknowledged the need to determine whether this interference had occurred before or after the start.
Mr Lamb, the Official Race Starter, who was present at the hearing, was unable to assist as to whether the interference occurred before or after the start.
Reasons for Decision:
We were satisfied that "Alta Capone" moved down and made contact with "Cam Before The Storm" immediately before the start or as the starting tape was being released. We were also satisfied that this was the sole reason for "Cam Before The Storm" going into a break and losing all chance in the race.
After careful analysis of the race video footage we considered the contact between the two horses was immediately before or at the instant the starting tape was released.
In our view "Cam Before The Storm" was materially prejudiced in the race due to the interference and any doubt as to precisely when the interference occurred should favour this horse. The horse finished in last position in the race. As a consequence of our ruling it should be declared a Late Scratching.
