Facts:

Following Race 3, The Power Farming Maiden over 1200m, a protest was lodged pursuant to Rule 642(1) by Ms A Morgan alleging that horse number 9 (QUEEN OF EXCUSES) or its rider placed 2nd by the Judge interfered with the chances of horse number 3 (WISH YOU WERE HERE) placed 3rd by the Judge.

The information alleged interference over the final stages.

 Judges placings were:

1st          HAMMER (5)

2nd         QUEEN OF EXCUSES (9)
3rd          WISH YOU WERE HERE (3)
4th          MI APACHE HORSE (8)
5th           WIGGLE (4)
The official margin between 2nd and 3rd was half a neck.

Submissions for Decision:

Ms Morgan told the committee that she was racing on the outside of QUEEN OF EXCUSES when that horse moved outwards and interfered with her causing her to lose a “good couple of lengths”. The Stipendiary Stewards showed the head-on, side-on and rear view videos of the incident which happened just prior to the finish post. Ms Morgan said she had to stop riding and believed she would have finished second. Mr Litt asked the committee to note the mowing strips on the head-on film and showed where QUEEN OF EXCUSES moved off her line of running and caused interference to his horse WISH YOU WERE HERE. He said that Ms Morgan was forced to stop riding and the margin was only half a neck at the finish.

Mr Ramsay admitted his horse had rolled out a little but said he could not see where Ms Morgan stopped riding and he demonstrated on the video where she continued riding hands and heels to the finish. He also believed that WISH YOU WERE HERE had moved inwards slightly. Using the side on film he showed his horse in front and “going away with it” towards the post. He was surprised that a protest had been lodged.

For the Stewards Mr Goodwin said while it was obvious that interference had taken place it was only a few strides off the finish and they would not support the protest being upheld.

Reasons for Decision:

In coming to a decision the committee carefully considered all of the evidence presented. It was clear that there was contact between the two horses which occurred when QUEEN OF EXCUSES moved outwards under pressure. We were not convinced that WISH YOU WERE HERE contributed to the interference. Of significance was the manner in which QUEEN OF EXCUSES ran to the line. She was always travelling better and finishing faster than the third horse. Consequently we were not satisfied that, free of interference, WISH YOU WERE HERE would have finished ahead of the second-placed horse.
