Following the running of Race 8 (NZB Insurance Pearl Series Race “MY BINNIE” Mdn) Information A14149 was filed with the Judicial Committee. It was alleged that Mr Montes de Oca (PINSK) used his whip excessively in the home straight.
Mr de Oca said that he understood the Rule, Charge and confirmed that he admitted the breach.
Mr Goodwin showed the film replays and said that Mr de Oca used his whip a total of 9 times prior to the 100m, with some of the strikes being consecutively.
Mr de Oca agreed with the Stipendiary Steward’s interpretation of this whip use.

Mr Goodwin said that the record showed that Mr de Oca last breached the Rule on 26 March 2021 when a fine of $300 was imposed.
Ms Clapperton said that Mr de Oca does not get a lot of rides and as his mount was in with a chance of winning he got a little over-excited.
Reasons for Penalty:
The JCA penalty starting point for a second breach of the Rule is a fine of $500. The Committee determined that there was not any reason why there should be a departure from the starting point.
