Following the running of Race 6, an information was filed by Stipendiary Steward McIntyre, against Open Licensed Driver D J Broadhurst, alleging a breach of Rule 869(2)(a) in that Mr Broadhurst:
"Used your whip in an excessive manner in the run home when driving RICHARD JAY"
Rule 869(2)(a) provides as follows:
“No horseman shall during any race:- (a) use his whip in an unnecessary, excessive or improper manner"
Facts:
Mr Broadhurst admitted the breach and elected not to be present. The charge was taken as read.
Mr McIntyre provided a Summary of Facts and with the assistance of the race video, illustrated that in the run home, Mr Broadhurst had struck RICHARD JAY a total of 31 times with the whip in alternative backhand and forehand motions.
Submissions for Decision:
Mr McIntyre submitted that 31 strikes in the run home was excessive in terms of the relevant guidelines.
