At the conclusion of race, 1 The Ascot Park Hotel Passing Lane Trot, an information was lodged by Stipendiary Steward, Mr C J Allison alleging that in the run home Mr D R Gordon used his whip in an excessive manner while driving out Winfield Dougall.
Facts:
Stipendiary Steward, Mr Allison used several video clips of the alleged incident highlighting to the Committee Mr Gordon striking his horse Winfield Dougall on 23 occasions in the run home.
Mr Allison stated that in his opinion Mr Gordon's action was continuous and at no stage did he attempt to break up the striking action.
Submissions for Decision:
Mr Gordon (Winfield Dougall) did not dispute the number of times he struck the horse but he wished the Committee to consider the fact that the horse finished on under his urgings and that he needed to be kept up to his work.
Mr Gordon pointed out to the Committee that it was his obligation to insure the horse did it's best and that this particular horse had in a recent trial responded to his urgings more so than in his recent racing.
Reasons for Decision:
The video evidence showed Mr Gordon had struck Winfield Dougall 23 times continuously from the top of the straight to the winning post.
Submissions for Penalty:
Mr Allison stated that Mr Gordon only had a few race day drives each season and that he had no previous breaches under this rule over the past twelve months.
Mr Gordon made no submissions on penalty.
Reasons for Penalty:
The Committee was of the opinion that the breach of the rule was mid range on the scale of excessive however, the fact that Mr Gordon did not at any point break up his action which proved to be very compelling in fixing penalty.
