Ms Hemi’s Jockey’s Licence was suspended from the end of racing on 18 January up to and including racing on 29 January 2020.

Facts:

Subsequent to the running of Race 8 (Bluestar Anniversary Handicap Group 111) Information No. A11675 was filed with the Judicial Committee. It was alleged by the Informant that Ms Hemi allowed her mount LA BELLA ROSA to shift in near the 1500m when not clear of HINERANGI dictating that runner inwards crowding JESSIEGEE, PEP TORQUE and INDAH.

Ms Hemi said that she understood the Rule, Charge and confirmed to the Committee that she admitted the breach of the Rule.

Mr Goodwin identified all runners involved on the film replays. He then said that Ms Hemi angled inwards when not clear, causing interference and crowding to the inside runners. He added that JESSIEGEE and INDAH were checked, with HINERANGI and PEP TORQUE being crowded.

Ms Hemi for her part said that the incident was pretty clear on the films in that she checked a few runners. She said that she thought she was clear and that she did not expect HINERANGI to go forward with her. She added that her judgement was wrong when she went in.

Submissions for Penalty:

Ms Hemi’s record showed three prior breaches of the Rule in the last 12 months. The most recent being on 29 August 2019 when a 5-Riding Day Suspension was imposed. Since that breach Ms Hemi has had 217 raceday rides without breaching Rule 638(1)(d).

Mr Oatham said that in his opinion Ms Hemi’s record was a neutral factor. He said an aggravating matter was that it was a Group Race and that he placed the carelessness in the mid-range.

Ms Hemi said that her last suspension was almost 6 months ago and that her record was quite good as she had had a lot of rides since. Ms Hemi asked for a week’s deferment as she had riding engagements on 18 January.

Reasons for Penalty:

The Committee was satisfied that the carelessness was not less than mid-range. The JCA Penalty Guide starting point for such a breach is an 8-Riding Day Suspension which the Committee adopted. Taking into account the admission of the breach, the number of horses interfered with, Ms Hemi’s record in recent times and that the breach occurred in a Group 111 event, the Committee determined that an 8-Riding Day Suspension was a suitable penalty.
