ID: JCA12309
Meet Title:
Timaru HRC - 21 March 2014
Meet Chair:
SChing
Meet Committee Member 1:
RMcKenzie
Race Date:
2014/03/21
Race Number:
R3
Decision:
The protest was upheld, and ANGELINA JOLIE was relegated from 5th place to 9th place behind ALBUQUERQUE. The amended places are as follows:
1st ROCKNROLL ARDEN (3)
2nd GOODNESS GRACIOUS ME (2)
3rd TE AMO BROMAC (6)
4th CALA (7)
5th BAY EMERALD (4)
It was ordered that dividends and stakes be paid in accordance with that amended result.
Facts:
Following the running of Race 3, the Nevele R Fillies Series (Heat 6) Mobile Pace, an Information instigating a protest was filed by Stipendiary Steward Mr S Renault alleging interference by ANGELINA JOLIE (9), driven by Mr R May, who finished in 5th place, to ALBUQUERQUE (8), driven by Mr R Holmes, near the 1000m.
The Judge's placings in this race were as follows:
1st ROCKNROLL ARDEN (3)
2nd GOODNESS GRACIOUS ME (2)
3rd TE AMO BROMAC (6)
4th CALA (7)
5th ANGELINA JOLIE (9)
6th BAY EMERALD (4)
Rule 869(8) provides as follows:
“The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
Mr R May, representing the connections of ANGELINA JOLIE, had endorsed the information that the protest was not contested. He had also informed the Stewards that he did not wish to be present at the hearing.
Submissions for Decision:
Mr Renault gave evidence and showed the relevant films of the incident which occurred near the 1000m. Co-Chief Stipendiary Steward Mr N McIntyre, who was assisting at the hearing, pointed out ANGELINA JOLIE racing in a 3 wide position and improving past ALBUQUERQUE. As ANGELINA JOLIE was passing ALBUQUERQUE, ANGELINA JOLIE hung inwards, bumped and locked stays with ALBUQERQUE causing that horse to become awkwardly positioned and in restricted room behind CALA eventually causing ALBUQUERQUE to be checked, break and lose all chance. ALBUQERQUE eventually finished in 9th place. Mr Renault submitted the Stewards were seeking relegation of ANGELINA JOLIE to behind ALBUQUERQUE.
Reasons for Decision:
We carefully considered the evidence given and the video coverage of the incident. The Committee was satisfied that ANGELINA JOLIE had hung inwards, made contact and locked stays with ALBUQUERUE causing that horse to race in restricted room, eventually breaking, losing all chance.
Taking into consideration all factors, the Committee were satisfied that ANGELINA JOLIE had caused interference to ALBUQUERUE near the 1000m causing that horse to break. We therefore decided that the protest should be upheld.
