As the charge was admitted the breach was found to be proved. 

Penalty:

The committee imposed a monetary penalty of $200. 

Charge:

Mrs Allpress was charged with a breach of Rule 330(3)(b) in that she permitted herself to be engaged for more than one horse in Race 2.

Facts:

Mrs Allpress explained to the committee the sequence of events that led to the charge. She rode the horse SAVONT for licensed trainer Mr Finnegan one week ago at Otaki (March 11th). After the race Mr Finnegan asked her if she was available to ride the horse at its next start. Mrs Allpress said she would  but would confirm that with him once the fields were out.

On Sunday (March 13th) at the Waverley races Mr Kevin Gray told Mrs Allpress that he had a couple of possible rides for her at Woodville on Thursday March 17th.

When Mrs Allpress checked the nominations for Woodville on Monday she noticed that SAVONT was entered for a 1600m maiden 3yr old race. She sent Mr Finnegan a text saying "SAVONT OK". Mr Finnegan did not reply.

Soon after sending the text she noticed that Mr Gray also had a horse in the same race. Immediately she tried to contact Mr Finnegan to say that she was committed to riding Mr Gray's horse but despite trying to reach him for two days he did not respond to texts or phone calls.

Eventually Mrs Allpress enlisted the help of the stewards and the owner of the horse and a replacement rider (Mr O Bosson) was found for SAVONT.

Submissions for Penalty:

Mr Goodwin said that Mrs Allpress had a previous charge under this rule in December 2010 for which she was fined $100. He said that he had also had difficulty in trying to contact Mr Finnegan and his lack of communication made life difficult for all parties.

Mrs Allpress, while admitting the breach, implied that Mr Finnegan was also responsible because he failed to respond to her attempts to clarify matters. 

Reasons for Penalty:

In coming to a decision on penalty the committee had regard to all of the submissions put before it including Mrs Allpress's admission of the breach. It was our opinion that when she texted Mr Finnegan she made a firm engagement to ride his horse. She has a strong affiliation with Mr Gray's stable and when she noticed he had a horse entered in the same race she felt her priority was to ride that horse. Mrs Allpress had accepted rides on both horses and found herself unable to contact the trainer of SAVONT. This was unfortunate for Mrs Allpress but she did make a mistake in accepting a ride on Mr Gray's horse before being released from the ride on Mr Finnegan's horse. 

In setting an appropriate penalty we were mindful that Mrs Allpress had a similar previous charge in December last year.
