The breach is admitted and therefore the charge is proved.

Penalty:

Mr Kamaruddin is fined the sum of $300.00.

Facts:

Following the running of the BURTON 1215 an Information was lodged by Stipendiary Steward Mr A Coles against Apprentice Jockey Mr J Kamaruddin  alleging that Mr Kamaruddin as the Rider of SPEED OF LIGHT used his whip excessively prior to the 100 metres mark.

Rule 638(3)(b)(ii) provides: A Rider shall not strike a horse with a whip in a manner or to an extent which is excessive.

The NZTR Whip Guidelines that came into force on the 7th of October 2020 provide that there is a limitation of 5 strikes with the Whip prior to the 100 metres mark.

Mr Kamaruddin was present and he acknowledged that he understood the Whip Guidelines and that he admitted the breach. Mr Kamaruddin was assisted by Mr N G Harris the Apprentice Jockey's Mentor.

Stipendiary Steward Mr A Dooley demonstrated the incident by use of the race films. He identified Mr Kamaruddin riding SPEED OF LIGHT and showed where he used his whip 8 times prior to the 100 metres mark.

Mr Kamaruddin agreed with the number of strikes.

Mr Harris said that the strikes were over a reasonable distance without a lot of aggression.

Submissions for Penalty:

Mr Coles said that Mr Kamaruddin had a good record under this Rule and this was his first breach. He said that in terms of the Guidelines the prescribed penalty was a fine of $300.00.

Mr Kamaruddin and Mr Harris accepted the proposed fine.

Reasons for Penalty:

The films are very clear and the number of strikes is agreed. The Penalty Guidelines provide for a fine of $300.00 and there are no compelling reasons to deviate from this.
