It was ruled that “Lord Diego” was a starter in this race.
Facts:
Following the running of Race 7, the Resource Recycling Technologies Akaroa Cup, an Information was filed by Open Horseman Mr J. R. Dunn the driver of “Lord Diego” (14). This Information was a Request for a Ruling pursuant to Rule 213(1)(j) as to whether his horse had been denied a fair start.
The Information reads as follows.
“I the abovenamed informant hereby apply to the judicial committee and seek a ruling on the following matters:
J. Dunn alleges that the chances of Lord Diego were materially prejudiced at the start when the barrier strand failed to release correctly.”
Rule 213(1)(j) reads as follows.
“(1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:-
(j) if a horse is denied a fair start and such occurrence materially prejudiced the chances of that horse.”
Submissions for Decision:
Mr Dunn gave evidence and used video coverage to show that his horse had started in the outside unruly position at the 10 metre mark, with three other horses starting on his inside. Mr Dunn said that when the barrier strands were released the 10 metre strand was released incorrectly and “spooked” his horse, and that as a result its chances were prejudiced.
Video coverage clearly showed that all barrier strands were released at the same time. This was confirmed by Starters Assistant Mr G. Sandford, who was in attendance at the 10 metre starting point.
It was also established that at this time Mr Dunn had his horse positioned back from the barrier as is required of an unruly horse. Mr Dunn also agreed that there was no contact between the barrier strand and his horse.
Stipendiary Steward Mrs Williams made submissions that the barrier strands had been released correctly, and that there was no evidence to show that there was anything unusual about the start of this race.
We adjourned to consider our decision.
Reasons for Decision:
We carefully considered the evidence and the video coverage of this incident. While it was shown that “Lord Diego” made a slow start we were satisfied that there was no evidence that this was caused by the barrier strand. We decided to rule that the chances of “Lord Diego” were not affected by the barrier, and declare it a starter in this race.
