As Mr Jones admitted the breach we find the charge proved.

Charge:
Following race 6, Campbell Infrastructure Rotorua Cup, an information was filed pursuant to Rule 638(2). The Informant, Mr Williamson, alleged that Mr Jones made a celebratory gesture prior to the winning post.
Mr Jones acknowledged that he understood the nature of the charge and the Rule.
Rule 638(2) states : A rider shall not make a celebratory gesture prior to his horse passing the winning post.
Facts:
Mr Williamson demonstrated on the video film that Mr Jones made a celebratory gesture 2 strides prior to the winning post.
Mr Jones told the Committee that he thought he had past the winning post when making his celebratory gesture. He said it was hard to line up the winning post due to him racing wide out on the track. He said he made a celebratory gesture because it was his mount's 3rd win in the race.
Submissions for Penalty:
Mr Williamson submitted that Mr Jones had an excellent record under this rule. He said similar breaches had attracted fines ranging from $100 to $350. He submitted a fine of not more than $200 would be appropriate.
Mr Jones submitted a fine of $100 would be acceptable.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Jones' admission of the breach and his clear record. The aggravating factors are the Group 3 status of the race and we assessed the gesture as being extravagant.
We further explained to Mr Jones that the Rule was in place for safety reasons which are paramount.
The Committee informed Mr Jones the recommended starting point for this breach is a $300 fine.
We referred to the JCA listing of penalties for similar breaches which showed a $200 fine would be an appropriate penalty.
