Facts:
Following the running of Race 9, Vernon & Vazey Truck Parts Premier, an Information was filed by Chief Stipendiary Steward, Mr JP Oatham, against Licensed Jockey (Class A), Ms SL Wynne, alleging that Ms Wynne, as the rider of GLORIOUS OCEAN in the race, “permitted her mount to shift inwards over the concluding stages crowding PONIARD (S R F Weatherley) inwards onto BOOGIE EASY (S T Collett)”.
Ms Wynne was present at the hearing of the Information and she indicated that she admitted the breach.
Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.
Mr Oatham had Stipendiary Steward, Mr MR Davidson, show video replays of the incident. Mr Davidson pointed out GLORIOUS OCEAN, ridden by Ms Wynne, approaching the 100 metres riding her mount forward. To her inner was PONIARD (S Weatherley) and, on the inside of that runner, BOOGIE EASY (S Collett). There were runs for those two horses, but Ms Wynne’s mount was shifting in under pressure and being ridden with the whip. Miss Collett’s mount was forced across heels, Mr Davidson said.
Ms Wynne said that she could feel her mount “wandering” in. She straightened it and struck it again with the whip but it shifted in again. She said that she was doing her best to straighten but be competitive at the same time.

Mr Oatham said that Ms Wynne’s most recent charge was at Southland on 17 July 2020 – a COVID-reduced penalty of 3 days for a mid-range breach. Prior to that she was suspended at Greymouth on 5 January 2020 - two suspensions on the same day, one 6 days for a low-end breach and the other 8 days also for a low-end breach. Mr Oatham said that her record had been poor but, since the breaches at Greymouth in January, there had been an improvement with only one breach since that time. Her most recent breach was 190 rides ago. Her record could be considered as neutral, Mr Oatham submitted. This present breach was in the low-to-mid range, he submitted.
Ms Wynne said that she had engagements at the meeting at Palmerston North on 21 November and she sought a deferment of suspension until after that meeting. She asked the Committee to show leniency, if possible. She has been trying hard, she said, and today she thought she had done enough.

The Committee assesses the level of the breach as being in the low-to-mid range, as submitted by Mr Oatham. That triggers a starting point of a 7 national riding days suspension under the Penalty Guide. Ms Wynne’s riding record, we take as being neutral.
