As the charge was admitted the charge was found ro be proved.
Penalty:
Accordingly we imposed a fine of $300.
Charge:
Following Race 9, the Tod Seeds Manawatu Challenge Stakes Group 3, an information was lodged by the Stewards alleging a breach of Rule 638(2) in that S Spratt made a celebratory gesture prior to the winning post on MUFHASA.
Facts:
Mr Neal showed the side-on video of the final stages of the race which showed Ms Spratt raise her whip just prior to the finish post. He explained that the stewards had a policy of rigidly enforcing breaches of this rule and Ms Spratt had been approximately 1 and a half strides short of the post when she looked across at the crowd and raised her whip in a celebratory gesture.
Submissions for Penalty:
Mr Neal told the committee Ms Spratt had one previous breach of this rule incurred at Hawkes Bay on the 22/9/12 in a Group 1 race where she was fined the sum of $300. He said the breach today was towards the lower end.
Ms Spratt had no submissions to make on penalty.
Reasons for Penalty:
In coming to a decision on penalty the committee took into account the nature of Ms Spratt’s celebratory gesture, her record under this rule and the stake and status of the race. Whilst we considered the breach to be minor, as it was immediately prior to the post and Ms Spratt did not stand up and wave the whip in an extravagant manner, we were concerned that this was her second charge in three months.
