The protest was upheld. Placings now read

1st Ramwood Raider 1
2nd McArdle Lassie 9
3rd County Down 10
4th Cruz Control 3
5th The Oyster Bar 13
Royal Mission (horse 8) was relegated to 9th position behind Alta Panache. Dividend and stakes were allowed to be paid on the amended placings.

Facts:

At the conclusion of Race 8 the siren sounded indicating a protest brought under Rule 869 (8).
The information alledges interference by horse 8 'Royal Mission' to horses 13 'The Oyster Bar' and 14 'Alta Panache' with 400 metres to run.
The provisional placings as called by the judge were 1 - 9 - 8 - 10 - 3.

Submissions for Decision:

Mr. Taumanu using the available films pointed out the alledged incident when Mr. Paris, driving Royal Mission, allowed his horse to move inwards placing pressure on 'The Oyster Bar' which in turn pressured 'Alta Panache' who in turned forced 'McArdle Lassie' over the pylons for some distance.

He believed Mr Paris' drive was hanging but a lack of judgement and horsemanship was the primary cause of the incident.
Miss. Chilcott agreed his drive was hanging but she also agreed in her words it was not a good drive.

Mr. Mangos concurred his drive was effected.

Reasons for Decision:

In coming to our decision we carefully viewed all available films. They clearly showed although 'Royal Mission' was hanging, Mr. Paris allowed his drive to move inwards placing pressure on 'The Oyster Bar' who broke when interfered with. This breaking caused interference to the two other horses.
