As the breach was admitted we find the charge proved.
Penalty:
Accordingly Miss Moki is suspended from riding in races from after the conclusion of racing on 23rd May until after racing on 3rd June(4 days). These include 27 May Te Aroha, 30 May Ellerslie, 1 June Ellerslie and 3 June Matamata.
Facts:
Following race 1, the Bill Woods Memorial 800, an information was filed pursuant to rule 638 (1) (d). The informant alleged that near the 600 metres Miss Moki allowed her mount SHERADREAM to shift in when not clear of DROUGHT BREAKER (A Collett) who was dictated into the line of SEATTLE (A Schwerin) which was checked.
Rule 638 (1) (d) reads: a rider shall not ride a horse in a manner which the judicial committee considers to be careless.
Mr Oatham demonstrated the video films pointing out SHERADREAM (Z Moki) racing in a 4 wide position approaching the 600 metres and going into the first bend. He then showed Miss Moki allowing her mount to shift in across the heels of ENIGMA MACHINE. Mr Oatham said Miss Moki was only a bare length clear of DROUGHT BREAKER when moving in and this caused Miss Collett to take a hold of her mount resulting in crowding to SEATTLE who had to be checked.
Miss Moki said the films were clear and she had nothing to add.
Mr R Collett said SEATTLE, which was the horse most affected, reacted badly to the incident but conceded Miss Moki was not quite clear. However he said it was obvious that interference did occur through Miss Moki moving in.
Submissions for Penalty:
Mr Coles produced Miss Moki's record which showed 2 suspensions in the last 12 months, the most recent being on the 8 November which incurred a 4 day suspension. He said Miss Schwerin did receive a reasonable check but conceded they were green two year olds, several of whom were having their first start. Mr Coles submitted a suspension at the low end would be appropriate suggesting one of 4 days.
Miss Moki said she had commitments until after racing on 23 May.
The committee then queried Miss Moki as to whether she had any intentions to ride in the central districts on industry days in the near future. She replied she had a new manager who was hopeful to obtain rides in that region. On further questioning Miss Moki was unable to provide evidence that she was going to ride in the central district in the near future. This policy is in accordance with the JCA penalty guide effective 1 May 2015.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions as presented. Mitigating factors are Miss Moki's admission of the breach, her good record for an apprentice rider and the field consisted of many two year olds who were inclined to race greenly. However this was counteracted by Miss Moki being only a bare length when shifting in.
The committee assesses her level of carelessness to be at the low end.
After taking all the above into account we find the appropriate penalty to be one of 4 days.
