As Mr Reid admitted the breach the charge is proved.

Accordingly, Mr Reid is fined the sum of $250.

Facts:

Following the running of race 2, the Carters Tyres 2200, an Information was filed pursuant to Rule 638(3)(b) alleging that Amateur rider Mr J Reid used his whip in an excessive manner prior to the 200 metres.

Mr Reid acknowledged that he understood the nature of the charge and the relevant Rule. He confirmed his admission of the breach.

Rule 638(3) (b) provides: A rider shall not strike a horse with a whip in a manner or to an extent which is unnecessary, excessive or improper.

Using available video footage Mr Williamson demonstrated that Mr Reid, the rider of HENRY TUDOR used his whip at least 35 times from the 600 to 200 metre mark. He said that Mr Reid used his whip 10 times between the 600 and 400 metre mark and paused for 5 strides and then a further 25 times to the 200 metre mark without pausing.

Mr Reid advised the Committee that he agreed with the Stewards' account of the breach and he had nothing further to add, other than he now appreciates what he did wrong. 

Submissions for Penalty:

Mr Coles advised the Committee that Mr Reid has a clear record and he should be given credit for his early admission of the breach. He said the number of strikes (35) in these circumstances places the breach at in the mid-range. He submitted that the breach could be dealt with by way of a fine in the vicinity of $150 to $250.

Mr Reid submitted that he should be given credit for his good record and admission of the breach. He also said that this was his 4th race day ride and acknowledged his lack of experience was a factor. 

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions of the Informant and Defendant. The mitigating factors are Mr Reid’s admission of the breach and his clear record under this Rule, noting that as an Amateur he has limited race riding experience.

The Committee noted the Use of Whip Guidelines which requires a rider to cease using the whip for at least 6 strides prior to it being used again. When applying those guidelines to this breach the Committee determined that the number of strikes (35) and frequency were well outside the acceptable level and we assess the breach as being in the mid to high range.

In consideration of penalty the Committee took into account penalties for similar breaches as well as JCA Penalty Guidelines which establish a starting point for a breach of this rule at $300 (1st breach within a year).

After taking into account all the above factors, and noting that as an Amateur Mr Reid does not receive a riding fee, the Committee considers a fine of $250 is an appropriate penalty.
