Penalty:

Mr Parkes was suspended from racing riding after this Saturday, 19 October 2013 until the completion of racing on Friday, 25 October 2013 (3 North Island days).

Careless riding.

Facts:

Mr J Parkes did not admit a breach of Rule 638(1)(d) in that he allowed his mount TINKA TINKA to shift out when not clear of I AM LEO over the final stages.

Rule 638(1)(d) reads -  A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless

Submissions for Decision:

Mr Goodwin using the available film informed the committee that Mr Parkes did not stop riding or attempt to take steps until too late when his mount moved outwards into the line of I AM LEO.  He submitted that Mr Parkes did take remedial action a fraction late and by then interference had occurred.

Mr Parkes using the films informed the committee that, yes he did move outwards but, by using the whip on the shoulder of the horse and controlling the reins he believed he was able to mitigate the movement outwards.  His mount was difficult to ride especially in a tight situation and the action and method he used was best suited to that particular horse.

Mr Goodwin asked the committee to consider that the films clearly showed that Mr Parkes did not stop riding at the point of the incident.

Reasons for Decision:

In coming to its decision the committee viewed again the available films.  These clearly showed that Mr Parkes did take remedial action but only after the damage had been done.  The movement outwards did take I AM LEO's line.  At no stage in leading up to and including the point of the incident did Mr Parkes stop riding.

Submissions for Penalty:

Mr Goodwin submitted that the Stewards viewed the incident at the lower to medium end of the scale.  Mr Parkes was a senior rider who has really come of age as a rider.  He was last suspended under this rule in February this year and received a 3 day penalty.  He is viewed as a North Island rider only.  Mr Goodwin submitted the penalty imposed should reflect his excellent riding record.  He asked for a penalty of 4 days.

Mr Parkes indicated he was happy to leave any penalty imposed to the committee but did ask for consideration to be given to his riding record.

Reasons for Penalty:

In coming to its decision to impose a penalty of suspension for the breach, the committee took into account, Mr Parkes' excellent riding record (last suspended under this rule in February), the submission of the stewards who classed the breach in the lower to medium range, his excellent demeanour during the hearing and his strong belief that the riding action and method he uses in tight situations is, in his opinion, the correct one.

Starting from a point of 5 days, the committee was adamant that the points raised in submissions and the fact that Mr Parkes' riding ability had been recently rewarded by winning his first Group One race should be reflected in the penalty.

The committee did not wish to comment on Mr Parkes' strongly held views on his riding actions in a tight situation except to concur with his comments during the hearing that yes, he did move outwards and yes, the remedial action he did take at the point of the incident was a fraction late.

The committee was strong in the view that the points raised in the submissions on penalty should be reflected in a reduction of 2 days from the 5 day starting point.
