Mr Freeman admitted the beach and thus we find the charge proved.

Penalty:

Mr Freeman is fined the sum of $200 and is ordered to pay Mr Chong the Declared Rider of Vindication a losing riding fee.

Charge:

Stipendiary Steward Mr M Davidson stated to the committee that trainer M A. Freeman failed to have his horse Vindication on course by the required time. 

Mr Freeman admitted the breach and did not wish to appear before that committee.  

Facts:

Mr Chong, the Declared Rider for Vindication, approached the Stipendiary Stewards approximately 15 minutes before race start time, stating that he could not find the trainer Mr Freeman or the horse Vindication. Stipendiary Steward Mr McLaughlin stated that he had rung MR Freeman, to ask where he was and was told by Mr Freeman that he had “Missed a turnoff and was some distance from Winton and could not make the racecourse on time.” 

Submissions for Penalty:

Stipendiary Steward Mr Davidson stated the fact that Mr Freeman had made no effort to contact the club or Stewards was the reason the information had been brought before the committee. Mr Davidson also stated that the late scratching was a financial cost to the Winton Club, and that jockey MR Chong was denied a riding fee. He recommended a range of penalty from $100 to $200.

Reasons for Penalty:

In fixing penalty the committee considered the admittance of the beach from Mr Freeman, along with financial loss to the club and jockey Mr Chong who was denied a race ride through no fault of his own.
