Penalty:
The Committee grants a deferment to Mr Waddell’s suspension pursuant to Rule 1106(2).
Accordingly, Mr Waddell had his license to ride in races suspended for a period to commence after racing on 7 October and conclude after racing on 18 October 2018.
Facts:
Following the running of race 2, CAMBRIDGESTUD.CO.NZ, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Oatham, alleged that Mr Waddell allowed his mount BEVAN STREET to shift in when not sufficiently clear of HATTON GARDEN which was checked near the 1000 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Waddell said he understood the Rule and confirmed that he admitted the breach.
Mr Jones demonstrated the incident using the available video footage. He identified that near 1000 metres Mr Waddell was riding his mount forward when he shifted in one horse width on the point of the bend. He said BEVAN STREET was only three quarters of a length clear of HATTON GARDEN and as a result that runner was severely checked losing between one and a half and two lengths.
Mr Waddell said that he made a poor error of judgement. He said that HATTON GARDEN was racing in his “blind spot” and he thought that Mr Calder had taken a hold of HATTON GARDEN. He added that at no stage did Mr Calder call out to him.
Submissions for Penalty:
Mr Oatham produced Mr Waddell’s record which showed 4 previous breaches under this Rule in the last 12 months, the most recent suspension was 24 March in the Rosehill Guineas. He said that Mr Waddell has had 206 rides in the last 12 months and he was fully co-operative with the Stewards. Mr Oatham described the level of carelessness as no less than mid-range and his record was fair.
Mr Waddell said that he had firm commitments up to and including 7 October and any proposed suspension could start after that date. He noted that three of his careless riding charges occurred in Group 1 races and he was normally a very cautious and safe rider. He said given his admission of the breach a 6 day suspension would be appropriate.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
It was evident on the video films that Mr Waddell permitted his mount to shift in one horse width when only half a length clear of HATTON GARDEN just prior to the bend near the 1000 metres . The inward shift was a gradual manoeuvre however, Mr Waddell failed to look to his inside and as a consequence HATTON GARDEN was severely checked losing two lengths. The Committee deemed the inward shift to be low range carelessness and the consequential effects were mid-range. Therefore the totality of the carelessness was low to mid-range.
The JCA Penalty Guide starting point for low to mid-range carelessness is 7 days which was adopted.
The aggravating factor was Mr Waddell’s fair record which necessitated a 1 day uplift in penalty. Regard was had for the fact that a reset for one of the careless riding charges will happen on 28 October 2018.
The only mitigating factor was Mr Waddell’s admission of the breach for which a 1 day reduction was applied.
After taking into account all the above factors the Committee considered that an appropriate suspension was 7 national riding days.
