As the breach was admitted we find the charge proved.

Penalty:

Accordingly we impose a suspension on Miss Collett from riding in races which is to start after racing on 24 November and conclude after racing on 28 November 2010 (4 riding days).

Facts:

Mr Williamson demonstrated the video films which showed EL TORRO  ridden by Miss N Collett racing in a 3 wide position approaching the 1200 metres.  From this point Miss Collett allowed her mount to move in and take the line of NOBLE WARRIOR (M Hills) when only a bare length clear.  As a result both horses were put off stride with Mr Hills having to check his mount.

Miss Collett in admitting the breach had nothing to say.

Mr Oatham said this was Miss Collett's second charge in the last 12 months which was a very good record for the number of rides she has.  He said this was a case of misjudgement on Miss Collett's part in not allowing enough clearance before moving in.  He submitted a 4 - 5 day suspension would be appropriate. 

Miss Collett submitted that she had commitments up to and including the Te Aroha meeting on 24 November.  She said she rode throughout the country which was confirmed by Mr Oatham. 

Reasons for Penalty:

The committee carefully considered all evidence and submissions.  Mitigating factors are Miss Collett's admission of the breach and her very good record.  The aggravating factor was the inward movement by Miss Collett when insufficiently clear resulting in the check to NOBLE WARRIOR.  Taking the mitigating factors into account we believe the appropriate penalty is one of 4 days.
