Facts:
Following the running of race 7, Waharoa Transport Container Division 1600, an Information was filed pursuant to Rule 638 (3)(b)(ii). The Informant, Mr Jones, alleged excessive use of the whip by Mrs Satherley on the horse SUGGESTIVE HEIGHTS prior to the 100 metres.
Mrs Satherley acknowledged that she understood the Rule and confirmed her admission of the breach.
Rule 638(3)(b)(ii) provides: A Rider shall not:
(ii) strike a horse with a whip in a manner or to an extent which is excessive
The “Guidelines With Respect to Acceptable Use of the Whip” provides:
Without affecting the generality of Rule 638(3)(b) a rider may be penalised if their whip use is outside of the following guidelines:
Inside the final 600 metres of any Race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached. Prior to the final 600 metres of a race, official trial or jump-out the use of the drawn whip is acceptable if used in moderation and not continually.
Mr Oatham demonstrated the incident using the available video footage. He identified Mrs Satherley and showed that from the 300 metres until the 100 metres Mrs Satherley struck her mount 11 times. He said the whip use wasn’t continuous and there were two pauses for 4 strides as opposed to the required 5 strides. He added that Mrs Satherley won the race.
Mrs Satherley stated although that it was no excuse, the track was very heavy and she was in front and going to win the race. Mrs Satherley confirmed that she was aware of the new whip guidelines.
Submissions for Penalty:
Mr Jones said that Mrs Satherley had a clear record in the month that the new guidelines have been in place. He stated that jockeys were given a clean slate in regard to the excessive whip breaches from the 1st of August 2017. He said the frequency of strikes was not “5 on and 5 off” and submitted that a $300 fine would be a fair penalty.
Mrs Satherley asked for a light as possible penalty.

The Committee carefully considered all the evidence and submissions presented.
The starting point for a 1st breach of this new Rule is a $300 fine with the expectation that no reduction in penalty is applied unless the mitigating matters are exceptional.
There were no aggravating factors.
The mitigating factors were Mrs Satherley’s admission of the breach and her clear record under this Rule. The Committee assessed the severity of strikes and the number of strikes (11) as being in the low range. When reviewing the incident it was evident that Mrs Satherley was only just outside the guidelines. We observed that Mrs Sathereley ceased using the whip for 4 strides on 2 occasions. The Committee deemed this breach to be at the low end of the scale.
The Committee notes that SUGGESTIVE HEIGHTS won the race but there was no evidence or suggestion that any advantage had been gained.
