Mr Chowdhoory has admitted the charge and it is found proved.
Penalty:
Mr Chowdhoory is suspended from the end of racing on 1 January 2021 up to and including 7 January. This is four days, and he is fined the sum of $500.
Facts:
Following the running of Race 6, the Stewards charged Mr K Chowdhoory (OUR GIRL GILLY) with a breach of r 638(1)(d) in that he permitted his mount to shift outwards forcing WEKA FORCE outwards on to ROCANTO which in turn checked JOHNNY JONES and AMASTAR.
Mr McIntyre demonstrated on the videos that Mr Chowdhoory who was racing 2 off the fence shifted outwards just after the apex of the corner. In so doing he placed a number of runners in restricted room. The side-on video evidenced that the Respondent was just a length clear at the time.
Mr Chowdhoory said he was aware the horse was shifting ground under pressure. He had tried to straighten OUR GIRL GILLY. There was no yelling from the other jockeys.
Mr Pitman said that OUR GIRL GILLY had had lots of starts and was a difficult horse to ride in that it had a tendency to run out. He said Mr Chowdhoory was trying to ride the horse out and on this occasion it had rolled out. He said the impact on the jockeys to Mr Chowdhoory’s outside was amplified by the jockey to his immediate outside not taking a run to the inside of Mr Chowdhoory when that had clearly presented itself after the horse had shifted ground. He said the Respondent had hit the horse five times in total and twice as it was shifting ground. He said Mr Chowdhoory was a vigorous rider and was trying to straighten the horse while getting the best out of it.
Submissions for Penalty:
Mr Davidson produced Mr Chowdhoory’s record which showed three previous breaches of this rule in the last 12 months although only one since COVID. He described the breach as being between mid and low range and, while there was crowding, it was not as bad as it appeared on the video, with AMASTAR being the worst affected. He submitted the Committee should take into account it was a Listed Race.
Mr Pitman did not disagree with the Informant’s description of the breach. Mr Pitman sought deferment of Mr Chowdhoory’s penalty until after the meeting at Riverton on 1 January 2021.

Mr Chowdhoory has allowed his mount to shift out passing the 300 metres dictating WEKAFORCE outwards onto ROCANTO who was dictated out onto JOHNNY JONES and AMASTAR with both these runners being checked. Mr Chowdhoory was using the stick and there were two strikes as the horse was shifting ground.
The NZTR Revised Penalty Guidelines for careless riding provide a starting point of a $500 fine and a 5-day suspension for a mid-range breach. The Committee accepts the Informant’s description of the breach as being between mid and low range as correct. Mr Chowdhoory was using the stick and there were two strikes as the horse was shifting ground and interfering with the runners to his outside.
The Committee takes a starting point of a $500 fine and a 4-day suspension due to it being between mid and low range and increases this by one day for the fact that it is a Listed Race. Mitigating factors are that OUR GIRL GILLY is a difficult horse to ride, that the Respondent took corrective action, albeit a stride or two too late, and the admission of the breach. Mr Chowdhoory’s record is a neutral factor as there is only one breach in the past nine months.
