Mr O’Reilly was charged with a breach of r 869 (3) (b), in that he allowed his horse SOUNDS LIKA GEM to strike the sulky wheel of DONEGAL GILBERT about 200 metres from the finish, in race 8.
Mr Renault outlined the relevant position of SOUNDS LIKA GEM as the field approached the home straight with the aid of the videos. He said Mr O’Reilly improved his horse from the one-one position behind DONEGAL GILBERT.
About 200 metres from the finish SOUNDS LIKA GEM struck the sulky wheel of DONEGAL GILBERT when shifting outwards to challenge for the lead. The head-on video clearly showed that DONEGAL GILBERT had shifted outwards slightly prior to the contact being made, which was a contributing factor.
