Facts:
Following the running of Race 1, the Invercargill Workouts Committee Trot, two Informations Instigating Protests were filed by Stipendary Steward Mr C J Allison alleging firstly that Sea Spray Ronnie (L C Stuck) broke in excess of 50 m in the home straight, and secondly that Monnay (B D McLellan) also broke in excess of 50 m in the straight. All parties agreed that the hearings could be held together (there was a problem with the sound system and it took some time to gather all parties).
Rule 870(3) &(4) & Breaking Horse Regulations are as follows:
(3) Any horse which breaks from its gait shall promptly regain its proper gait.
(4)(a) Which fails to promptly regain its proper gait: and /or may (in addition to any other penalty imposed pursuant to Rule 1003 hereof) subject to the provisions of the Breaking Horse Regulations made by the Board, be placed by the Judicial Committee immediately after any other horse in respect of which any advantage may have been gained.
Submissions for Decision:
Mr C Allison used video film to show that Sea Spray Ronnie (L Stuck) broke with approximately 100 m to run and continued in a gallop to the finish post. Mr Stuck agreed with the evidence as presented. The Committee, after discussion, disqualified Sea Spray Ronnie from 3rd position effectively moving the number 4 horse into third place. However Mr C Allison continued with Information No.13728. Mr Allison once again used the same Video Film to demonstrate where Monnay (no 9) had broken at approximately the 200m mark and had continued in a break for approximately 200m. Mr McLellan agreed with the evidence presented, and after a brief deliberation the Committee decided to disqualify Monnay from 4th position.
Reasons for Decision:
The Committee were satisfied that both horses, Sea Spray Ronnie and Monnay were in breach of Rule 870 (3)&(4) (a) and the 'Breaking Horse' Regulation and that both horses should be disqualified.
