Facts:
Following the running of Race 1 an Information was filed by Stipendiary Steward Mrs C Tibbs alleging a breach of Rule 869(2) by Amateur Driver Mr M Stratford. The information alleged, You used your whip on more occasions than permitted by Clause (b) of the Use Of Whip Regulations.
Mr Stratford had signed the Information stating he admitted the breach and confirmed to the Committee he had a clear understanding of the whip regulations.
Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulation made by the Board.
The Use of Whip Regulation (effective from 30 November 2017) provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mrs Tibbs used the race video with the assistance of Mr Williams to identify Mr Stratford driving (3) XMAS BAY, racing three places back on the rail at the 400 metres. Mr Stratford, the Committee and the Stewards counted 13 strikes with the whip in the run to the finishing post.
The Committee asked Mr Stratford if he had anything to say and he stated the ear plugs were not fully out on his first try and he considered he was lucky he had to stop driving and make another attempt.

Mrs Tibbs stated Mr Stratford had a clear record under this rule and the Stewards were seeking a $200 fine as per the Guidelines.

The JCA Penalty Guide provides a sliding scale for a first offence where there have been 11 to 13 strikes which entails a $200 fine, mitigation inclusive.
The Committee finds this an appropriate penalty.
