Facts:
Mr Allison stipendiary steward alleged that DEVIL MAY CARE (Mr P Hunter) shifted inside the pylons in excess of 30 metres in the home straight.
Judge’s placings were:
1st ROCKIN ROLL LAD
2nd MIDNIGHT DYLAN
3rd DEVIL MAY CARE
4th ALBERTO CONTADOR
5th MONAGHAN
6th ARDGHAL.
Submissions for Decision:
Mr Allison had Mr Wallis, stipendiary steward, demonstrate that in the last 200 metres Mr Hunter had gone for a run in the passing lane and, in so doing, his horse had moved inside the pylons.
Mr Allison submitted that the distance was some 50 metres.
Mr Hunter said it was his horse’s first start under lights and he had tried to keep it way from the pylons. He said he thought the distance DEVIL MAY CARE was inside the pylons was closer to 40 metres.
Reasons for Decision:
We viewed the incident from 2 different video angles. We are satisfied that the distance DEVIL MAY CARE was inside the pylons in the home straight was at least 40 metres and was closer to 50. This is clearly in excess of the 30 metres permitted by rule 869(7B).
The rule is clear. DEVIL MAY CARE must be disqualified in these circumstances unless the breach was due to interference by another horse or horseman. Both parties agree that neither of these circumstances apply.
