As Mr Grylls has admitted the breach the charge is proved.

Penalty:

The Committee therefore suspends Mr Grylls from riding in races from after racing at Te Rapa on 24 October until after racing at Avondale on 2 November, a 3 day suspension.

Facts:

Following the running of Race 2, the FAIRVIEW MOTORS 1200, an Information was presented by Mr Jones alleging that Mr C Grylls, riding MARAINI had shifted out near the 1000 metres when not sufficiently clear of TOUTE SUR ROUGE (Mr M McNab) which was hampered, losing ground.

Mr Grylls was present at the hearing and acknowledged that he understood the Rule and that he admitted the breach.

Using the available video films Mr Coles identified the horses involved. As the field neared the 1000 metres, SOLOMAN (Mr S McKay) was in the lead, with MARAINI inside that horse. Mr Coles pointed out that MARAINI, which was over-racing, was allowed to drop back slightly behind SOLOMAN by Mr Grylls, who then angled the horse inwards behind SOLOMAN. In doing so TOUTE SUR ROUGE, which was racing behind SOLOMAN was placed into restricted quarters forcing Mr McNab to restrain that horse. In doing so the horse lost approximately 1 to 1 1/2 lengths. Mr Coles pointed out that when MARAINI shifted inwards towards TOUTE SUR ROUGE it was insufficiently clear of that horse. Mr Coles said that there was barely a length between the horses at the time and that was the reason Mr McNab had to restrain his mount. Mr McNab had told the Stewards that his horse had also been racing keenly prior to this incident.

Mr Grylls said that he had obviously not been clear of Mr McNab when he shifted out towards his horse. However he added that he did not believe he had hampered TOUTE SUR ROUGE to any great degree. He also said that in the preliminary investigation into the incident Mr McNab had said that his horse probably was not going to figure in the finish of the race.

Submissions for Penalty:

Mr Jones presented Mr Grylls' riding record which showed no previous breaches of this Rule since November 2015. He added that the Stewards viewed this breach as being in the low to mid range and submitted that Mr Grylls' admission could be taken into account when assessing a penalty. Mr Jones stated that Mr Grylls had ridden at the Hawkes Bay carnival recently, had ridden at the Ashburton Feature meeting on the previous Saturday, and had ridden at other Feature meetings recently at Wanganui and Marton. However he had no history of riding at Industry meetings outside the Northern area recently.

Mr Grylls stated that he had engagements at Te Rapa on 24 October and could start any period of suspension after that.

The Committee took into account the submissions of the parties relevant to penalty.

Mr Grylls has an excellent record relating to any breaches of this Rule. He is a busy rider and we take into account his admission of the breach. The Committee also accepts that the consequences of Mr Grylls' actions in this matter were at the lower end of the scale, the initial inwards movement being partly to avoid any other interference due to his horse racing somewhat erratically. 

The JCA Penalty Guide has a starting point of a 5 day suspension. Mr Grylls is classed as a Northern rider when considering any industry type meetings, and the Committee believes that an appropriate penalty would be a suspension of 3 days, taking into account the above matters.
