Facts:
An Protest information was lodged by Stipendiary Steward Mr T Taumanu following Race 5.
The protest was against Horse 8 Canyouwatchoverme placed 3rd by the Judge on the grounds that it broke from its gait in excess of 50 metres over the concluding stages and in doing so failed to lose ground.

The information was served on trainer and part Owner Mr B Lloyd who signed and endorsed it indicating he did not wish to contest the protest. Both he and driver Mr G Wolfenden left prior to the hearing.
Stipendiary Steward Mr Muirhead referred to video footage of the concluding stages of the race and identified Canyouwatchoverme.
Just before the 50 metre mark the horse broke and continued to gallop beyond the finish line improving as it did so and being lapped on by the fourth placed horse as it crossed.

Mr Taumanu submitted that the horse Canyouwatchoverme had clearly breached rule 870(3) through the application of the Breaking horses Regulations which state...
'(b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater,shall be deemed to be in breach of Rule 870(3) in that it failed to promptly regain its proper gait'
He explained the Stewards were seeking the disqualification of the horse pursuant to Rule 1003. The connections had been advised of this potential outcome prior to the hearing.
