Facts:

Mr Renault, Stipendiary Steward, alleged that Mr May in race 8, the Airpark Canterbury Hannon Memorial Pace, used his whip on more occasions inside the final 400 metres than is permitted by cl (b) of the Use of the Whip Regulations.

Clause (f) of the Use of the Whip Regulations provides: “The whip must not be used excessively prior to the final 400 metres.”

Mr Renault demonstrated on the videos that the respondent, who was driving AG’S WHITE SOCKS, was leading on the final bend and racing down the home straight. Mr May used his whip 14 times in the last 400 metres.

Mr May indicated on the information that he admitted the breach and did not wish to be present at the hearing.

Mr Renault produced the respondent’s record. Mr May had 624 drives last season, and has had 80 this season. Mr Renault said that although this was a Group 3 Race it was not regarded as a “major race” for the purpose of the Penalty Guide, as the stake was $30,000.

The count for Mr May is 14. Mr Renault tells us Mr May agrees that this is the number. We note the strikes were in a staccato fashion at the finish of the race.

Mr May has a clear record under this rule for the past 12 months. The Penalty Guide provides a $300 fine where the number of strikes is between 14 and 16 (mid-range) and the respondent has a clear record. There are no aggravating or mitigating factors that require an adjustment to this starting point.
