As Mr Asano admitted the breach, it was deemed to be proved.
Penalty:
Accordingly, Mr Asano’s license is suspended from the close of racing on Sunday March 7th, up to and including racing on Thursday March 18th, 2021. In addition, he is fined the sum of $750.
In the event of Sunday’s race day being held on Monday March 8th, the suspension will begin after that day.
Facts:
Following the running of Race 4 an Information was lodged by Mr Oatham alleging a breach of Rule 638 (1) (d) in that K Asano (PRINCE OF TALLIN) allowed his mount to shift outward near the 400m when not clear of KUASA KUDA (D Hirini) which was forced outwards onto the heels of SASKATCHEWAN.
Four video angles were available for review. Mr Goodwin showed Mr Asano in a racing position 4-back adjacent to the running rail. KUASA KUDA was slightly ahead and to his outside. Mr Asano’s mount was improving rapidly when he eased out and attempted a run between two horses in front of him. As he moved out Mr Asano forced KUASA KUDA outwards across the heels of SASKATCHEWAN causing Ms Hirini to clip heels. She recovered but the incident resulted in her forcing another horse to her outside out over extra ground.
Ms Clapperton said there was minimal outward movement by Mr Asano.

Mr Oatham presented Mr Asano’s riding record which showed 4 breaches of the Careless Riding Rule in the last 12 months:

17/10/20 Auckland low range 5 days
7/11/20 Riccarton low/midrange 7 days
5/12/20 Auckland low 9 days
Mr Oatham said while this record may look bad Mr Asano has had 500 rides in the last 12 months which is a large number for a Rider. In addition, he has ridden through the last 3-month period without a careless riding charge. The Stewards placed the degree of carelessness in the midrange and submitted a period of suspension commensurate with that was appropriate.
Ms Clapperton said Mr Asano was a very good Rider and was just a little overcompetitive at times. Mr Asano said he understands the need to display a little more patience when waiting for a run.
He advised of riding commitments through until after the Derby on either Sunday March 7th or Monday March 8th (Covid lockdown dependent).
Reasons for Penalty:
The Committee considered all submissions. PRINCE OF TALLIN was full of running in behind the leading horses when Mr Asano eased outwards approximately 1 horse-width. It was a gradual movement and, in many circumstances, would not have caused any trouble. On this occasion however Ms Hirini’s mount blundered badly, and another runner was carried wide on the track. Mr Asano went on to win the race.
It was our opinion the carelessness was in the midrange and we adopted a starting point of 5 days suspension and a $500 fine. We have taken into account the large number of rides Mr Asano has had in the last 12 months but still consider his record to be an aggravating factor. He has a pattern of low-level breaches which supports Ms Clapperton’s claim that he lacks some patience.
Balancing up all factors an appropriate penalty is one of 7 days suspension.
