As the breach was admitted we find the charge proved.

Accordingly and under the provisions of rule 1106 (2) we impose a suspension of Miss Spratt's riding license which is to start after racing on 13 February and conclude after racing on 23 February 2013 (6 North Island Days).

Facts:
Following race 3 an information was filed pursuant to rule 638(1)(d). Mr J Oatham alleged that near the 1100 metres Miss S Spratt permitted her mount to shift in when not clear causing crowding to JIMMY HOFFA (C Lammas), DARTING (M Du Plessis) and SIR LANCELOT (D Johnson) who were all checked.
Submissions for Decision:
Mr Williamson demonstrated the relevant video films which showed ARGENTE racing in a position 3 from the outside soon after the start. He pointed out Miss Spratt then angling her mount in and in doing so crowd 3 runners on her inside. Mr Williamson stated she was only 3 quarters of a length clear of JIMMY HOFFA when moving in which resulted in heavy contact to the 3 runners mentioned. He concluded by saying these 3 runners each lost approximately 2 lengths.
Miss Spratt in admitting the breach had no submissions to make.

Mr Oatham produced Miss Spratt's record which showed 4 suspensions in the last 12 months. He conceded that in today's breach she did make some effort to straighten but continued riding forward. Mr Oatham said there were significant checks to 3 horses and submitted the breach was in the mid to high range. He concluded a 6 to 7 day suspension would be appropriate.
Miss Spratt said she had commitments up to and including 13 February and when questioned she said she did not have any rides in the South Island in the near future.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. The only mitigating factor is Miss Spratt's admission of the breach. The aggravating factors are that interference was suffered by 3 horses and this is Miss Spratt's 5th breach in 12 months. The committee independently assesses the breach to be in the mid range and finds an appropriate penalty to be one of 6 days.
