The Committee ruled that both PRINCE TEKA and NAVARA were denied a fair start. It was ordered that they both be scratched from the race.
It was further ordered that dividends for the race be amended accordingly.
Facts:
Following the running of Race 9, the Allied Security-Supporters of Addington Handicap Trot, an information requesting a ruling under Rule 213 (1) (j) was filed by Stipendiary Steward, Mr S Renault to determine whether PRINCE TEKA, driven by Mr K Cameron and NAVARA, driven by Mr J Ford, were denied a fair start.
Rule 213 provides as follows:
(1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:-
(j) if a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.
Submissions for Decision:
Mr Renault showed video replays of the start of Race 9, a standing start 2600 metres event for trotters. He pointed out PRINCE TEKA, driven by Mr Cameron, having drawn 4 off the front with ARRAN CHIEF, driven by Mr A Faulks, drawn in the 5 off the front position. Drawn 11 on the second line, he pointed out, was NAVARA, driven by Mr J Ford. Mr Renault showed that as the start was declared, ARRAN CHIEF, who was angled in towards PRINCE TEKA, stepped inwards into the line of that horse. He pointed out PRINCE TEKA attempting to move forward with the start, but with ARRAN CHIEF partially blocking his line, the sulky wheel of PRINCE TEKA went over the hind hoof of ARRAN CHIEF and as a result the sulky was tipped up with Mr Cameron being unseated. Mr Renault then showed NAVARA, who was starting from a position behind PRINCE TEKA, who was totally blocked from improving away from the start by the stationary PRINCE TEKA and unseated driver, Mr Cameron.
Both Mr Cameron, PRINCE TEKA and Mr Ford, stated that they were denied a fair start.
Reasons for Decision:
After careful consideration and review of the films, the Committee was satisfied that both PRINCE TEKA and NAVARA were denied a fair start by suffering an occurrence that materially prejudiced their chances. The start was in process when ARRAN CHIEF shifted into the line of PRINCE TEKA causing that horse to run over the hoof of ARRAN CHIEF and unseat the driver, which materially prejudiced PRINCE TEKA’s chances of a fair start. NAVARA was materially prejudiced at the start as his way was blocked by the stationary PRINCE TEKA and unseated Mr Cameron, therefore we ruled was denied a fair start.
