As the breach was admitted we find the charge proved.

Penalty:

Accordingly we impose a suspension on Miss Collett from riding in races which is to start after racing on 5 January and conclude after racing on 15 January 2011 (6 rising days).  In addition we impose a fine of $1000.

Facts:

Mr Oatham demonstrated the video films which showed MISS RAGGEDY ANN, ridden by Miss N Collett, racing on the outside of the field in the run up the home straight.  Approximately 200 metres from the finish Miss Collett allowed her mount to shift in and take the line of MONTON (H Bowman) when insufficiently clear.  This caused Mr Bowman to take a hold of his mount and lose momentum. 

Submissions for Decision:

Mr Oatham said MISS RAGGEDY ANN was inclined to lay in and while Miss Collett made some effort to straighten she continued to ride forward.  He said MONTON was checked at a vital stage of the race. 

Miss Collett said her horse was laying in but admitted she continued to ride forward as it was a Group 1 race.  She said she had an awkward ride.

Submissions for Penalty:

Mr George said Miss Collett had 2 previous suspensions in the last 12 months which was a very good record.  However he said this breach was in a Group 1 race and although the interference to MONTON was not severe he submitted Miss Collett's carelessness was at the high end.  He stated a 5 to 8 day suspension plus a fine of $1000 - $1500 would be appropriate. 

Miss Collett said she had commitments up to and including  5 January and did ride throughout the country.

Reasons for Penalty:

The committee carefully considered the evidence and submissions as presented.  Mitigating factors are Miss Collett's admission of the breach and her good riding record.  However the committee is very mindful this was a Group 1 race for a stake of $200,000.  Miss Collett continued to ride forward with little attempt to straighten her mount.  This resulted in the check to MONTON  as described above.

A suspension and a fine for the one breach should only be used in special circumstances.  We have considered Mr George's submission that a fine of $1000 - $1500 should be imposed in the case of Miss Collett.  The committeee is satisfied that a fine at the low end of what Mr George has submitted is appropriate.  The combined penalty of a fine and a supension should not amount to a higher penalty than one which would have b een imposed with riding days only.  However it is there to act as a deterrent in races such as this which is the committee's reason for agreeing to the submission.
