The protest is upheld and MAGIC WOMAN is disqualified from the race.

It was ordered that dividends and stakes be paid in accordance with the amended result.

Facts:

Following the running of Race 9 an Information Instigating a Protest was lodged by Stipendiary Steward Mr TW Taumanu against the fourth placing of horse number 3 MAGIC WOMAN (Driver BM Mangos) on the grounds of breaking with approximately 140 metres to race and continuing in that break for the rest of the race.

Mr BM Mangos the Driver of MAGIC WOMAN represented the connections of the horse and endorsed the Information with the words “I do not contest the Protest”.

Rule 870(3) provides:

“Any horse which breaks from its gait shall promptly regain its proper gait”.

The Breaking Horse Regulations Part B provides:

Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of rule 870(3) in that it has failed to promptly regain its proper gait.”.

Submissions for Decision:

Stipendiary Steward Mr JM Muirhead on behalf of Mr Taumanu demonstrated the incident by use of the video films. The films showed quite clearly MAGIC WOMAN breaking at about 140 metres from the finish and continuing on in a break for the rest of the race.

Reasons for Decision:

The protest is not contested and clearly the provisions of Rule 870(3) and The Breaking Horse Regulations apply.
