Charge:
Following race 10 the informant Mr A Coles lodged an information pursuant to rule 638 (3) (b). He alleged that Miss Robertson used her whip in an excessive manner when riding BLACK FOX.
Facts:
Mr Williamson demonstrated the video films and pointed out to the committee Miss Robertson striking her mount 16 times prior the 200 metres mark, Mr Williamson submitted that Miss Robertson has failed to give her mount the required respite.
Miss Robertson submitted that she took the opportunity to practice using the whip.
Submissions for Penalty:
Mr Coles said Miss Robertson had a clear record under this rule, however he pointed out that Miss Robertson had just returned to race riding in the last month after a lengthy absence. He believed a $200.00 fine would be appropriate.
Mr Ralph submitted he would prefer Miss Robertson to be given a warning.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented, we explained to Ms Robertson that is not acceptable to practice using the whip on race day.
Mitigating factors are Miss Robertson clear record although in a limited career, her admission of the breach.
The aggravating factor was Miss Robertson failed to give her mount the required respite.
