As Mr Chowdhoory has admitted the breach, the charge was found proved.

Penalty:

Mr Chowdhoory was fined the sum of $250.00 and reminded of his professional obligations.

Facts:

Following the running of Race 7 the Central Southland Freight and AON Insurance Winton Cup an Information was filed by Stipendiary Steward Mr M Davidson against Licensed Apprentice Jockey (Class B) Mr K Chowdhoory, alleging he failed to make the required weight for Nopele.

Mr K Chowdhoory was present at the hearing and he confirmed he understood the rule and he indicated he admitted the breach.

He was assisted by Mr T Moseley (Class A Rider).

Rule 330 (3) (c) provides as follows:

A rider shall not:

(c) Fail to ride a horse at the weight it is handicapped to carry

Stipendiary Steward Mr Davidson stated that post race that the Stewards had been made aware that K Chowdhoory had ridden his mount Nopele 1kg overweight. Mr Davidson said that when questioning Mr Chowdhoory, and the clerk of the scales, they both had been advised that the trainer of Nopele Miss J Gordon was happy for the horse to be ridden 1kg over weight.

Mr Davidson said that all three individuals had the responsibility to advise the Stewards and that Mr Chowdhoory should not have taken the mount knowing that he would be riding 1kg overweight.

Mr Davidson said that the clerk of scales had been severely reprimanded.

Mr Chowdhoory stated he had been confused as Nopele had been nominated for two races, he had contacted Miss Gordon who had said he was fine to ride 1kg overweight.

Mr Mosely supported Mr Chowdhoory’s comments and said that Mr Chowdhoory had made an error of judgement, which he recognised.

Submissions for Penalty:

Mr Davidson said in normal circumstances a fine of $100 was appropriate however Nopele had completed the race, hence the breach was more serious, a fine of $200 to $300 was sought.

Mr Davidson also stated there was no other relevant case under these particular circumstances to refer to. Mr Chowdhoory stated he was a busy rider, with up to seven or eight rides normally on race day.

Reasons for Penalty:

The Committee agreed with Mr Davidson’s summation, that the responsibility of notifying the Stewards was Mr Chowdhoory’s. He had made a serious error of judgement, as has Miss Gordon and the clerk of the scales.
