As Miss Collett had admitted the breach the charge was found to be proved.

Miss Collett was fined the sum of $200.

Facts:

Following the running of Race 1, the Rangiora New World Maiden, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Class A Rider, Miss A Collett, alleging that Miss Collett broke an engagement to ride BOB’STHEJOB and was replaced.

Rule 330(3)(a) reads as follows:

(3) A Rider shall not:

(a) wilfully or without reasonable cause break a riding engagement;

Miss Collett had indicated on the Information that this breach of the Rules was admitted, and she confirmed this at the hearing. She also confirmed she understood the charge and the Rule it was brought under.

McLaughlin stated that he had called Miss Collett at 1.50pm as she was not yet on course for the first race due to start at 2.45pm. He said he called her again with the calls going straight to answer phone. Mr McLaughlin stated that Miss Collett called when the first race was being run and he asked her if she knew she had a ride in the first race. She replied that she did but thought the first race was at 3.20pm.

Miss Collett explained that she had looked on the TAB website earlier in the week, before the fields were declared, and noted the first race was set down for 3.20pm and booked her flights accordingly. She did not realise that an extra race had been added which brought the time of the first race forward to 2.45pm. She said she did not check the race times once the fields were declared and that is was just a genuine mistake.

Submissions for Penalty:

Mr McLaughlin stated that the JCA Penalty Guide provided a starting point of a $200 fine for a breach of this rule. He said that he would leave it up to the Committee as to the level of the fine imposed.

Miss Collett elected to make no submissions on penalty.

Reasons for Penalty:

The JCA Penalty Guide provides a starting point of a $200 fine for a breach of this rule, mitigation included. The Committee determined that there were no aggravating factors to consider so no uplift in penalty is warranted. We therefore determined that a $200 fine was an appropriate penalty in this case.
