Mr Goindasamy’s Apprentice Jockey’s Licence was suspended from the end of racing on 22 July up to and including racing on 29 July 2020.

Facts:

Following the running of Race 5 (Happy 30th Matt Stent 1100) Information No. A12922 was filed with the Judicial Committee. It was alleged that Mr Goindasamy the Rider of HEZA LOOKER allowed his mount to shift in when not clear of VINO BELLA, which was forced into the line of ROC CHA which was checked near the 900m.

Mr Goindasamy and Mr Manning said that they understood the Rule, Charge and confirmed that the breach was admitted.

Mr Williamson identified the horses involved on the film replays and said that VINO BELLA and ROC CHA were attempting to hold their positions. He said that HEZA LOOKER shifted in and tightened VINO BELLA onto ROC CHA who was checked. Mr Williamson added that SERVILIA was also affected by the shift. He estimated that HEZA LOOKER was approximately 1 length clear when shifting in.

Mr Manning submitted that Ms Thornton (SERVILIA) was trying to hold her line and that the incident was mainly due to Mr Goindasamy’s inexperience. He further submitted that ROC CHA was checked after Mr Goindasamy had gone clear and that Mr Goindasamy pulled off as soon as he touched the inside horse.

Submissions for Penalty:

Mr Jones presented Mr Goindasamy’s record which showed 3 breaches of Careless Riding within the last 12 months.

The 3 being:

18.09.19    7 days
---05.11.19    9 days
---14.03.20    5 days

Mr Jones submitted that the record be considered a neutral factor.

Mr Manning submitted that the carelessness was low-range and that two riders were suspended for 2 days each at the recent Counties Meeting and asked for consistency. He advised that any suspension imposed could start after 22 July 2020.

Mr Goindasamy did not make any comment.

Reasons for Penalty:

The film evidence was very clear in showing that Mr Goindasamy allowed his mount to shift in when not clear and as a consequence VINO BELLA was forced onto ROC CHA who was tightened and checked with SERVILIA also being affected.

The Committee placed the carelessness in the mid-range category and adopted a starting point of 4 Riding Days Suspension.

Taking into account the record, admission of the breach and the number of horses interfered with, it was determined that a 3 Riding Day Suspension was an appropriate penalty.
