Mr Parkes is suspended for 3 riding days from the close of racing on Saturday 5 August 2017 to the close of racing on Saturday 12 August 2017 – the 3 days being Riccarton (9 August 2017), Woodville (10 August 2017) and Counties/Riccarton (12 August 2017).
Facts:
Following the running of race 5, the “B S Young Handicap” Information A8776 was filed by Stipendiary Steward, Mr N Goodwin under Rule 638(1)(d). The Information stated “that jockey J Parkes allowed his mount to shift inwards shortly after the start when insufficiently clear of LANDLORD which was checked”.
Mr Parkes signed the Information stating he admitted the breach and at the beginning of the hearing confirmed that was correct and also that he understood the Rule under which he was charged.
Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”.
Mr Goodwin, using the side-on, rear view and head-on films identified Mr Parkes who had drawn 8 in the 11 horse field shortly after the start. He said the films showed Mr Turner on NITRO TED who had drawn 6 moving across to gain a position close to the rail and pass in front of Mr Chan on LANDLORD without incident. He said Mr Parkes was following Mr Turner across but as he came across in front of Mr Chan he was not the required 1 length and another in front and as a result Mr Chan received a brief check and had to pull his horse back off the heels of Mr Parkes’ horse.
To a question from the Committee Mr Godwin said he believed Mr Parkes was only a length clear of Mr Chan when Mr Chan received the check.
Mr Parkes agreed he had been following Mr Turner across and had simply misjudged how far he was in front of Mr Chan when crossing him and also that he was not the required 1+1 length clear.
Submissions for Penalty:
Mr Goodwin said this was Mr Parkes’ first breach of this Rule since 21 January 2017 and only his second breach of the Rule this season. He said this was a very good record for a jockey who had had nearly 550 rides in the 2016/2017 season. He submitted the degree of severity was below mid range and that a period of suspension was an appropriate penalty. He did not, however, specifically state what he thought was an appropriate period of suspension.
Mr Parkes asked the Committee to note his very good riding record and also that he would like to seek a deferment of any suspension to allow him to ride at Te Rapa on Saturday 5 August 2017.
Reasons for Penalty:
The Committee has reviewed films of the incident and taken into account all the submissions made. All three views of the incident clearly show Mr Parkes moving across following Mr Turner and Mr Chan receiving a brief check as Mr Parkes came across in front of him. The Committee notes that Mr Parkes ended up 2 horse widths off the fence. The Committee believes the severity of the breach is closer to low than mid range because Mr Chan did not lose any significant ground in the incident.
The Committee has taken into account Mr Parkes’ early admittance of the breach and his excellent riding record. The Committee also notes that Mr Parkes has ridden regularly in the Northern district over the past 4-6 weeks and also that he was intending to ride at Riccarton for the last two days of the up-coming three day meeting.
The JCA’s Penalty Guidelines state the starting point for a breach of the careless riding rule is 5 riding days. From that start point we reduce the penalty by one day in recognition of Mr Parkes’ excellent riding record as detailed above. After further consideration we reduce the penalty by a further day for his admittance of the breach and in recognition of the low level of its severity. Mr Parkes will therefore be suspended for 3 riding days.
Mr Parkes confirmed he wished his suspension to commence after racing on Saturday 5 August 2017 and this was approved in terms of Rule 1106(2).
