Accordingly, the protest is upheld and the amended placings are now:

1st No. 2 EL BANDITO
2nd No.1 DOIKNOWYOU
3rd No.7 OOMPA
4th No. 4 EMPATHY

In conclusion I order the payment of stakes and dividends.

Facts:

Following the running of Race 2, Broadway Motel 1400, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr N Harris, alleged that OOMPA placed 2nd by the Judge interfered with the chances of DOIKNOWYOU placed 3rd by the Judge.

The interference was alleged to have occurred in the final straight.

The Judge's placing were as follows:

1st No. 2 EL BANDITO
2nd No. 7 OOMPA
3rd No. 1 DOIKNOWYOU
4th No. 4 EMPATHY

The official margin between 2nd and 3rd was a nose.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

All connections present acknowledged they understood the Rule.

Submissions for Decision:

Mr Harris demonstrated on the head – on film that in the final straight OOMPA shifted out 4 horse widths and dictated his rightful running line. Mr Harris said he had to change ground several times and believed the interference cost him at least half a length. He added the close margin of a nose at the finish.

Mr Ulucinar acknowledged that OOMPA shifted out in the final straight which resulted in DOIKNOWYOU being hampered. Mr Ulucinar said he was unable to use his whip in the right hand because Mr Harris was racing directly on his outer.

Mr Old submitted that OOMPA did shift out significantly in the final straight.

In response to a question from the Committee, Mr Old advised he did not contest the protest.

Mr Williamson on behalf of the Stewards submitted there were two significant shifts in the final straight. He said the initial shift occurred at the 150 metres which resulted in DOIKNOWYOU being forced over 3 additional horse widths. He noted OOMPA shifted out again at the 50 metre mark which inconvenienced DOIKNOWYOU when he was making headway on OOMPA. He concluded by saying the Stewards do support the protest.

Mr Harris and Mr Old had nothing further to add in summing up.

Reasons for Decision:

The Committee carefully considered all of the submissions and reviewed the video films. The head – on film is conclusive that OOMPA shifted out approximately 4 horse widths in the final straight. In doing so this resulted in DOIKNOWYOU being forced over extra ground and had its rightful running line taken. The films confirm DOIKNOWYOU was making ground on OOMPA and was beaten a nose at the finish.

Therefore, I am satisfied that DOIKNOWYOU would have beaten OOMPA had such interference not occurred.
