Facts:

Mr Williamson was charged with a breach of r 869 (2), in that he used his whip more than permitted under the Use of the Whip Regulations when driving MR MIDNIGHT in race 8.

Mr Renault, with the use of the videos, identified MR MIDNIGHT 3 back in the running line at the 400 metre mark. He counted 11 whip strikes from this point to the finish line, categorising it as a low end breach.

Mr Williamson said that he was “definitely over” the permitted maximum of 10 whip strikes inside the final 400 metres.

Mr Renault produced Mr Williamson’s record which referenced 52 drives this season and 459 drives last season. This was his second breach of the Whip Regulations inside six months. The JCA Penalty Guide provides a suspension of three to five days in these circumstances. Mr Renault said a three day suspension was appropriate to reflect the low end nature of the breach.

Mr Williamson had nothing further to add by way of a penalty submission.
