The Protest is upheld and BILLY AT SALSA is disqualified from the Race.

The amended placings are now:

first - (1) I'M JUST AWESOME

second - (2) MORE SHADES OF GOLD

third - (9) HALLEY'S LAST

fourth - (7) OUR PETITE LADY

fifth - (8) RAVE NATION

It is ordered that dividends and stakes are paid in accordance with the amended placings.

Facts:

Following the running of the DUNSTAN HORSE FEEDS MOBILE TROT an Information instigating a protest was lodged by Stipendiary Steward, Mr JM Muirhead against the 4th placing of BILLY AT SALSA (Driver Z Butcher) on the grounds that it broke aand galloped in excess of 50 metres in the final 200 metres of the Race.

Rule 870(3) provides that any horse that breaks from its gait during a race shall promptly return to its proper gait.

The Breaking Horses Regulations part (b) provide that any horse which breaks from its gait in the final 200 metres of a race and continues in a break for a distance of 50 metres or greater shall be in breach of Rule 870(3).

Mr Z Butcher the Driver of BILLY AT SALSA and also Stable representative endorsed the Information with the words " I do not contest the Protest"

Mr Muirhead demonstrated the incident by use of the race films and showed where in the straight BILLY AT SALSA broke from its gait prior to the 150 metres mark and continued in a gallop to the finish.

Submissions for Decision:

Mr Muirhead submitted that as BILLY AT SALSA had galloped well in excess of 50 metres it was in breach of Rule 870(3) and should be disqualified from the race.

The Protest is not contested and is therefore upheld.
